Compensation for medical negligence in Poland
We represent patients and their families in disputes with medical facilities in Poland and their insurers.
How we help
We guide clients safely through the complexities of Polish law, from the first consultation to a final judgment.
- Analysis of medical records and assessment of the chances of the case
- Compensation for harm suffered and damages for treatment costs
- Annuities for loss of earning capacity or increased needs
- Claims of close relatives after a patient’s death
- Proceedings with the facility’s insurer
- Court proceedings involving medical experts
How we work
- Conversation We listen to what happened and establish which documents are needed.
- Records We obtain the medical records and analyse them.
- Claim We submit the claim to the facility and its insurer.
- Court If the claim is refused, we take the case to court.
Medical negligence cases require careful analysis of the records and cooperation with doctors of various specialities. We handle them with due sensitivity, because behind every claim is real harm to a patient or their family.
A patient may claim compensation for the harm suffered, damages covering the costs of treatment and rehabilitation and, in some cases, an annuity. We help you assess which route is most favourable in your case.
Frequently asked questions
Which documents do I need for the first meeting?
Everything you have: treatment records, discharge summaries, test results, invoices and correspondence with the facility. We will help you obtain any missing medical records.
When does a medical negligence claim become time-barred?
As a rule, a claim for personal injury becomes time-barred three years from the day the injured person learned, or could have learned with due care, of the damage and of the person liable to redress it. The deadline should be determined individually, as it depends on the circumstances.
Is there an out-of-court route?
Yes. The claim can be submitted directly to the facility and its insurer, and in some cases a benefit from the Medical Events Compensation Fund is available. We advise which route is more favourable.
