Copyright, trademarks and intellectual property in Poland

We protect brands, creative work and intellectual assets. We register trademarks, draft licence agreements and handle infringement disputes.

How we help

We guide clients safely through the complexities of Polish law, from the first consultation to a final judgment.

  • Licence agreements and transfers of authors’ economic rights
  • Contracts with creators: designers, photographers, agencies and developers
  • Rights to marketing materials, websites and logos
  • Trademark applications with the Polish Patent Office and the EUIPO
  • Brand protection: oppositions and trademark infringement disputes
  • Protecting works against copying and unauthorised use
  • Unfair competition and protection of trade secrets
  • Cease-and-desist letters and lawsuits for copyright infringement
  • Defence against infringement claims

How we work

  1. Protection We establish what is protected: a work, a trademark or know-how.
  2. Rights We check the contracts, registrations and who actually holds the rights.
  3. Securing We register the trademark, put the contracts in order or respond to an infringement.
  4. Dispute We pursue claims or defend against them in court.

Companies often commission a logo, a website, photos or copy and only discover during a dispute that they never acquired the rights. Under Polish law, a transfer of authors’ economic rights must be made in writing and must list the fields of exploitation, so it is worth settling this before paying for the project.

The strongest protection for a company name and logo is a registered trademark. We help check whether the mark conflicts with earlier rights, choose the classes of goods and services and decide whether protection in Poland is enough or an EU trademark is needed.

In cases of copyright or trademark infringement or unfair competition, the right holder may demand, among other things, that the infringement stop, that its effects be removed and that the damage be redressed. We advise on how to pursue these claims effectively or how to defend against them.

Frequently asked questions

Does paying for a project mean we own the copyright?

No. Without a written agreement transferring the rights, the client has at most a licence, often of unclear scope. Economic rights pass only in the fields of exploitation listed in the agreement.

Should we register a trademark in Poland or in the EU?

A Polish trademark protects the brand in Poland; an EU trademark covers all EU member states. The choice depends on where you operate and plan to grow.

What should I do if someone has copied my materials?

Secure the evidence (dated screenshots, archived versions of the website) and consult the next steps. A pre-trial demand is often enough, but some cases call for a quick application to secure the claim.
