Insurance claims and compensation in Poland
When a Polish insurer refuses to pay or underpays, we help you recover what you are entitled to under the policy and the law.
How we help
We guide clients safely through the complexities of Polish law, from the first consultation to a final judgment.
- Analysis of the insurer’s decision and the policy terms
- Appeals against refusals and underpayments
- Damage to homes and property in Poland, e.g. flooding and fire
- Road accident claims under the perpetrator’s third-party liability insurance and under motor own-damage cover
- Damage to business assets and business liability insurance
- Lawsuits against insurers and parties responsible for the damage
How we work
- Documents We collect the policy, its general terms, the correspondence and the insurer’s decision.
- Assessment We check what the insurer left out and why.
- Complaint We file a reasoned appeal with a valuation of the damage.
- Court Where necessary, we take the case to court.
Insurers often value damage using their own cost estimates, leaving out part of the loss or relying on exclusions in the general terms. Many such decisions can be successfully challenged.
We represent injured parties in claims handling and before the courts, including clients who live abroad and suffered damage in Poland. In disputes with an insurer, what matters most is the documentation of the damage, an expert’s opinion and a careful analysis of the policy.
Frequently asked questions
How long does a Polish insurer have to pay?
As a rule, 30 days from notification of the damage. If the circumstances cannot be clarified within that time, the benefit is paid within 14 days of their clarification, and the undisputed part within the basic period.
When does a claim against an insurer become time-barred?
Claims under an insurance contract generally become time-barred after three years. The period may be calculated differently depending on the type of claim, so it is worth acting quickly.
What should I do after a refusal?
File a reasoned complaint with the insurer. You can also turn to the Financial Ombudsman (Rzecznik Finansowy) and, if the refusal is upheld, bring a claim in court.
