We protect creditors of Polish companies and help businesses regain stability. Experience in cross-border insolvency proceedings.

How we help

We guide clients safely through the complexities of Polish law, from the first consultation to a final judgment.

  • Lodging claims in Polish bankruptcy and restructuring proceedings
  • Protecting the rights of foreign creditors
  • Cross-border insolvency under EU rules
  • Set-off of claims against an insolvent company
  • Restructuring proceedings and arrangements with creditors
  • Liability of management board members for company debts
  • Bankruptcy petitions

How we work

  1. Assessment We review your position as a creditor or debtor and the deadlines that apply.
  2. Securing rights We lodge claims, file objections and protect your interests in the proceedings.
  3. Negotiations We negotiate arrangements and solutions with other creditors.
  4. Recovery We pursue the recovery of your claim, including from management board members where possible.

When a Polish business partner becomes insolvent, deadlines are short and mistakes are hard to fix. A creditor who acts quickly and knows the procedure has a much better chance of recovering at least part of the claim.

We have experience in cross-border insolvency proceedings and advise foreign creditors on how proceedings opened in Poland or in another EU country affect their rights.

Frequently asked questions

My Polish customer has gone bankrupt. What should I do?

Check the deadlines for lodging your claim and gather the documents that prove it. Contact us as soon as possible so we can assess your options, including set-off and claims against management board members.

Does a bankruptcy opened in another EU country affect assets in Poland?

In most cases, yes. Under EU rules, insolvency proceedings opened in one member state are recognised in the others. The details depend on the type of proceedings and where the debtor’s main interests are.

Can management board members be personally liable?

Under certain conditions, management board members of a Polish limited liability company can be liable for its debts, for example when they fail to file for bankruptcy in time. We assess whether this applies.
